CRIMINAL STATUTES THAT COULD APPLY TO TRUMP’S RETENTION OF GOVERNMENT DOCUMENTS

18 U.S.C. 1924 – Unauthorized Removal and Retention of Classified Documents or Material

Section 1924 makes it a crime to knowingly remove classified documents with the intent to retain them in an unauthorized location. There are a few problems with this statute, however, as applied to Trump. 

OFFICIAL INVESTIGATIONS AND CIVIL LAW SUITS AGAINST TRUMP

  1. Federal criminal investigation into White House records removal: Possible violations of laws related to the Presidential Records Act and the handling of classified material. Federal law bars the removal of classified documents to unauthorized locations. To bring criminal charges against Trump, investigators would need to prove he acted knowingly.

RUSSIA’S FABRICATED NARRATIVES

Russia spreads disinformation, distorts history for its own political purposes and promotes hugely damaging false narratives and disinformation about neighboring countries. Russia engages in information warfare with the goal to divide and polarize society, tear it apart, fragmentize it, incite hatred and infighting, initiating a struggle for destruction, or fuse the aggression and direct it against the current government.

GENOCIDE IN UKRAINE

There are reasonable grounds to believe Russia is responsible for (i) direct and public incitement to commit genocide, and (ii) a pattern of atrocities from which an inference of intent to destroy the Ukrainian national group in part can be drawn; and 2) the existence of a serious risk of genocide in Ukraine, triggering the legal obligation of all States to prevent genocide.
